About The Max Grumbacher Gallery

Introduction

The thalo/Max Grumbacher Gallery (“Gallery”) is an online platform for artists to showcase, promote, and sell their original artwork and reproductions. Grumbacher recognizes the challenges associated with artists marketing and selling their artwork and has created a platform that enables you to exhibit your talent, promote your artwork to a worldwide audience.

 

It is your responsibility to promote yourself and your artwork to buyers. The Gallery gives you tools to market your artwork to a community of clients and friends and link potential buyers to your social media pages.  Gallery members can also be featured in thalo.com social networks. Gallery members will also receive an RSS feed of their uploaded work. This joint effort will increase your exposure to potential customers.

Features and benefits of a Max Grumbacher Gallery Membership include:

  • Your own personalized gallery.
  • An efficient and economical way to promote and sell your artwork.
  • Multiple ways to sell your artwork.
    • You have the option to only sell your original artwork (i.e., fine art painting, sculpture, collage, pottery, ceramics, mixed media, and photography). If you sell your original artwork, you keep 100% of original artwork sales.
    • You have the option to sell fine art reproductions and/or poster prints (“Reproductions”) of your artwork.
      • Fine Art Reproduction is a high-quality print of your original artwork that is available for sale and is printed on mounted or rolled canvas.
      • Poster Print is a reproduction of your original artwork that is available for sale and is printed on poster paper.
    • You have the option to sell both your original artwork and Reproductions, as well.
  • You are under no obligation to sell your original artwork or Reproductions.
    • You can just use the gallery as a showcase where current and potential clients can view your work.
  • Innovative features to manage and market your personalized gallery.

 

First Steps to Becoming a Member
To become a member of the Max Grumbacher Gallery, please read the Gallery Overview for a quick reference on how the Gallery works. Please make sure that you also read the Artist Agreement, Terms and Conditions, and the Privacy Policy of this website. We also recommend that you read the Most Frequently Asked Questions. Gallery Overview

Ownership & Copyright

  • You retain full ownership and copyright of your original artwork.
  • Upon acceptance of the Artist Agreement, you have agreed to grant the Gallery a “non-exclusive, transferable, worldwide license,” which gives the Gallery permission to reproduce your artwork for Reproductions, if you elect the reproduction option. It also gives the Gallery the right to use your digitized artwork and other content as we deem appropriate to advertise, market, and promote the Gallery.
  • Watermarking: In order to protect you and your digitized original artwork from copyright infringement, we place a watermark over all of the images uploaded to our site.

 

Qualifying Process For Entry Into The Gallery

  • In order for you to sell your artwork in the Gallery, you must be 18 years or older and reside in the United States.
  • You must upload two (2) pieces of your artwork for the Gallery Board to review.
  • Your artwork must be pre-qualified and pre-approved before you can become a member of the Gallery.
  • To begin the qualifying process, sign up for a Membership by following the steps below. Your membership status is pending and payment is not required until you are approved by the Gallery Board and you have made the decision to become a Member.
  1. Go to “Register” and click on “as an artist.”
  2. Click on the “Sign Up Now” button.
  3. Fill out the form, upload your sample artwork, and click on the “Submit” button.
  4. While the Gallery Board is reviewing your sample artwork, your membership is “pending” and you will receive an email informing you that you have been issued a Pending Membership/Free Account.
  5. The Gallery Board Members will review your sample artwork and notify you of their decision within 24 hours. You will be notified of their decision two (2) ways:
    1. The Gallery will send you an email confirming your acceptance. If you do not receive an email from the Gallery within 24 hours, please contact us at support[at]maxgrumbachergallery.com.
    2. When you log in to your account, a message with the Gallery Board’s decision will appear on the “My Account” page.
  6. Once you are accepted into the Gallery, you can become a Member by following the instructions contained in either the acceptance email or the message that will be posted in your account.
  7. Once you become a paid member of the Gallery, you are an Authorized Max Grumbacher Gallery Artist.
  8. You must confirm that you are 18 years of age or older, read and accept the Terms & ConditionsPrivacy Policy, and the Artist Agreement.

 

Membership

Membership $29.99 per year - approximately 100 image capacity (image capacity will vary based on the sizes of your uploaded images)

Receive the following free gift:

  • Grumbacher Degas Oil and Acrylic Brush - long handle for oil and acrylic painting ($40 retail value)

 

Upon payment of your Membership fee, you will be prompted to set up your own personal gallery by filling out the respective forms and uploading your digitized artwork.

Please be sure that your Gallery account information is accurate. You will be asked to name your gallery. Click on “How do I create my customized gallery URL” for more details.

 

Remember, when you are filling out the Gallery account information, please be sure to use your legal name. This information will be used to process payments to you for the commissions from the sale of Reproductions, as well as other pertinent business matters.

 

Establishing A Selling Price For Your Artwork

You are in control of determining the selling prices of your original artwork and Reproductions.  We encourage you to increase the predetermined minimum price (established by the Gallery) for your Fine Art Reproductions and Poster Prints to properly reflect the appropriate pricing differential between them and your original artwork. Please Note: You may not offer your original artwork (in the Max Grumbacher Gallery) at a price equal to or less than the price of your Reproductions. Click here for Price Setting Guidelines.

 

The Gallery offers you the option to sell your artwork in multiple ways:

  • Original Artwork. You will be notified by the Gallery via email when a buyer is interested in purchasing your original artwork.  We recommend that you reply to the buyer within 24 hours in order to finalize the sale. This transaction is strictly between you and the buyer, the gallery is not involved in the actual sale of original artwork or the monetary transaction.  
  • Fine Art Reproductions.  Once you upload your artwork to the Gallery, the Gallery will deternine the sizes and the prices of the Reproductions that can be offered for sale.  The Gallery will determine the minimum price of each reproduction size that you choose to sell. You have the option of increasing the price, but you cannot sell below the predetermined minimum price of the Reproduction established by the Gallery. Furthermore, you may not offer your original artwork (in the Max Grumbacher Gallery) at a price equal to or less than the price of the Fine Art Reproductions.   • Poster Prints. Once you upload your artwork to the Gallery, the Gallery will deternine the sizes and the prices of the Poster Prints that can be offered for sale.  The Gallery will determine the minimum price of each Poster Print size that you choose to sell. You have the option of increasing the price, but you cannot sell below the predetermined minimum price of the Reproduction established by the Gallery. Your Compensation & Payment for the Sale of Reproductions

In order to receive compensation from the Gallery, you must accurately fill out the information requested when you set up your Gallery Account.

 

Remember, when filling out the gallery account information, please be sure to use your legal name. This information will be used to process payments to you for the sale of Reproductions, as well as other pertinent business matters.

  • Reproductions - You will be paid a commission of 15% for any Reproduction sold by the Gallery. The commission will be calculated based on the actual price of the print itself, and will not include taxes, duties, shipping costs, and/or insurance costs paid by the customer. Please be advised that all checks and payments will be send to the HOME ADDRESS listed in you account. Click here for an Example of the commission calculation.
  • The Max Grumbacher Gallery has a "30-day return policy" for buyers. The buyer has the right to return the Reproduction within 30 days of the sale date for a full refund.
  • Your commission payment for the sale of Reproductions will be earned  31 days subsequent to the buyer's order date ("your earned date" ).  Once that 31 day window has passed, the Reproduction is deemed accepted by the buyer and then we can begin to process your commission payment at the end of that month.  All commission payments are sent out on the 30th day of the month.
  • Example 1:  if the artwork was sold on September 28th, we wait for 30 days to elapse, (which is the amount of time that the buyer has to return the Reproduction).  Once you have reached the 31st day, Oct. 29th ("your earned date"), your check will be processed and sent out on Oct. 30th.
  • Example 2:  if the artwork was sold on June 5th, we wait for 30 days to elapse, (which is the amount of time that the buyer has to return the Reproduction).  Once you have reached the 31st day, July 6th ("your earned date"), your check will be processed and sent out on July 30th.

 

Procedures for the Sale of Original Artwork

  • When a buyer is interested in purchasing your original artwork, you will be notified by the Gallery via email. We recommend that you reply to the buyer within 24 hours in order for you to finalize the sale. This transaction is strictly between you and the buyer, the gallery is not involved in the actual sale of original artwork or the monetary transaction. 

Procedures for the Sale of Reproductions

 

The Gallery is responsible for expediting the Buyer's Reproduction order. If you want to check the status of your Reproduction sales, they will be listed on the “Sales Status” page of your account.  Please note that due to production time, that it may take up to 5 to 7 business days for the shipping status to appear.

Sales and Shipping Status Reports

You will be able to track all sales activity and shipments of your artwork and compensation calculations (i.e. commission payments for Reproductions) on the Order Details page. Please note that due to production time, that it may take up to 5 to 7 business days for the shipping status to appear.

 

Responsibility for Managing Your Gallery

  • It is your responsibility to  keep your gallery up to date with respect to original artwork that is available for sale. All status changes should be made as soon as possible, but no later than 48 hours subsequent to a change in the sale status of the item.
